Amnesty International is concerned for the safety of three human rights defenders in Wamena town, Jayawijaya District, Papua Province after priest and human rights defender, Terius Kogoya, was detained and questioned by the military on 8 May. Soldiers have also been looking for human rights activists Matius Murib and Luis Maday. In the past, activists involved in investigating and publicizing human rights cases in Papua have received death threats, been accused of defamation and summoned for questioning by the police.

At around 3pm on 6 May, soldiers from Jayawijaya District Military Command (Kodim 1702) arrived at the house of Terius Kogoya, the head of the Baptist church in Wamena who has been working to protect detainees arrested in connection with the attack on Kodim 1702 on 4 April. The soldiers confiscated a letter signed by the relatives of seven of the nine military personnel, which authorized lawyers to act on the detainees' behalf. On the evening of 7 May, three soldiers returned to Terius Kogoya's home. They reportedly threatened the priest and members of his family before leaving.

On the morning of 8 May, Terius Kogoya was detained without a warrant by soldiers and taken to Kodim 1702, where he was questioned about the 4 April attack. He was released at around 1pm, but the soldiers told him to return the following day with Matius Murib, a member of the Commission for Disappearances and Victims of Violence in Papua (Kontras Papua). He did not comply with this order.

While Terius Kogoya was being questioned at Kodim 1702, soldiers returned to his home, looking for Matius Murib and Luis Maday, the head of the Wamena office of the Institute for Human Rights Studies and Advocacy (Elsham). It is believed that the three men have been targeted because of their role in monitoring the human rights situation in the Wamena area during the ongoing security force operations which followed the 4 April attack.

Concern also remains for the eight civilians and nine members of Kodim 1702 named above. They are among at least 30 people who are known to have been arrested during joint police and military operations to find those responsible for the attack on Kodim 1702. Wim Logo, who was arrested on 6 April in Wamena, is now known to be still detained. He was initially detained with ten others in Kodim 1702 and was reportedly beaten. The ten others have been released. Wim Logo is currently being held at the Headquarters of the Military Police in Jayapura. There is no information on
his treatment, but there are concerns for his safety (see UA 95/03, ASA 21/010/2003, 9 April 2003 and follow ups).

According to unconfirmed reports, two workers with the Baptist church, Ketis Tabuni and Enggelek Tabuni, were shot dead on 4 May by members of the Indonesian Military (Tentara Nasional Indonesia, TNI) in Kuyawage, Wamena
District, during the course of ongoing security force operations in the area. The two were said to be collecting food from their garden at the time. Two others, Yinggen Tabuni and Alinus Murib were shot and injured by the military on 2 May. They were reportedly searching for missing members of their families at the time. Over a thousand people are said to have fled their homes as a result of the operations.
 

RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in Bahasa Indonesia, English or your own language:

- expressing concern for the safety of Terius Kogoya, Luis Maday and Matius Murib and urging the authorities to take concrete measures to guarantee their safety;
- urging the authorities to ensure that all members of the police and military are made aware of the legitimate role of human rights defenders and their responsibility to protect human rights defenders under the UN Declaration on the Rights and Responsibility of Individuals, Groups and Organs of Society to Promote and Protect Universally Recognized Human Rights and Fundamental Freedoms;
-  expressing  concern at reports that the eight civilians named above have been  tortured  or  ill-treated;      
-  urging  the  government  to  take immediate  measures,  in  accordance  with  its  obligations  under  the UN Convention  against  Torture  and  Other  Cruel  and  Inhuman  or Degrading Treatment  or  Punishment which it has ratified, to undertake an immediate, effective and impartial investigation of the torture allegations, including that  of  Mikael  Heselo  and  the  other six detainees and of the death of Yapenas Murib which is alleged to have resulted from torture;
- calling on the authorities to provide guarantees that none of those detained will be subjected to further torture or ill-treatment;
- urging the authorities to ensure that all the detainees receive unrestricted access to legal representatives of their own choosing, to relatives and to any medical attention they may require;
- urging the authorities to investigate the reports of extrajudicial execution of Ketis Tabuni and Enggelek Tabuni and to bring the perpetrators to justice.
